MISREKOGNISI KONSTITUSIONAL ATAS DISABILITAS TAK TAMPAK DALAM PUTUSAN MAHKAMAH KONSTITUSI INDONESIA

Abstract


Artikel ini menganalisis kesalahan pengakuan konstitusional dalam Putusan Mahkamah Konstitusi No. 130/PUU-XXIII/2025 mengenai pengakuan terhadap disabilitas tak terlihat di Indonesia. Penelitian ini bertujuan untuk Menganalisis apakah perluasan definisi disabilitas fisik untuk mencakup penyakit kronis telah bergeser secara substansial melampaui model medis sebagaimana diamanatkan dalam Convention on the Rights of Persons with Disabilities (CRPD). Penelitian ini menggunakan metode hukum normative dengan pendekatan doctrinal komperatif melalui teori rekognisi Alex Honneth, Capabilities approach Martha Nassbaum, dan crip theory rosemarie Garland-Thomson. Hasil penelitian ini menunjukkan bahwa persyaratan asesmen medis formal sebagai syarat pengakuan hukum masih mereproduksi medikalisme structural dan menimbulkan eksklusi epistemis terhadap penyandang disabilitas tak tampak. Artikel ini menawarkan konsep konstitusionalisme partisipatoris sebagai kerangka alternatif yang menitikberatkan pada kesetaraan substantif dan hambatan partisipatoris dalam pengajuan konstitusional.
